All discharge of condition applications are already in the public domain and can be obtained from the Council’s planning portal (https://www.guildford.gov.uk/article/24686/Search-for-information-about-a-planning-application -- please input 19/P/01541 into the keyword search box). Our decisions on discharge of condition applications will include the decision dates and references. From the decision notices you will be able to see if the application has been approved or refused.

See above. If the last decision on a particular condition was a refusal and no subsequent application has been made, it can be assumed that this is still outstanding.

EN/23/00150 received 01/05/2023
Alleged breach of condition 22, relating to working hours, of planning approval 19/P/01541, specifically that heavy machinery was operating at 08:30 on Monday 1st May 2023 (early May Bank Holiday).
Case closed 23/05/2025 - A one-off breach of condition has been admitted by the developer, but no further occurrences have been reported following discussions with the developer. As the breach appears to have been resolved by negotiation, no further enforcement action is intended and this case has been closed.
EN/23/00158 received 03/05/2023
Alleged breach of condition 15 of planning permission 19/P/01541, specifically that the minimum 10 metre wide buffer zone alongside the Stratford Brook has not been provided.
Case closed 03/09/2024 - The 10 metre buffer zone required to comply with Condition 15 is in place, and the condition has been formally discharged. This breach of planning control has been resolved by the retrospective discharge of the condition.
EN/23/00445 received 14/11/2023
Alleged breach of condition 8 of planning permission 19/P/01541, specifically that drainage from the site, during the construction period, into Stratford Brook, is taking place at more than the one approved location and is exceeding the maximum permitted discharge rate
Case closed 03/05/2024 - Condition 8 has been formally discharged, and the drainage from the site during the construction phase appears to be in accordance with the agreed methods. This breach of planning control has been resolved by the retrospective discharge of the condition.
EN/25/00092 received 18/03/2025
Alleged breach of conditions 9, 18 and 20 of planning approval 19/P/01541, specifically that occupation of the site has commenced without discharge of pre-occupation condition 9 related to a drainage verification report, and without provision of the package of works detailed in condition 18 and without provision of the highway improvement works in accordance with approved drawing number 14364-02-01 as required by condition 20
Case closed 12/06/2025 - Planning applications 21/D/00143/25 and 25/P/00630 received. If granted, these would wholly address the breach of planning control. No further action needed at this time but planning applications being monitored.
25/P/00630 still to be determined.
21/D/00143/25 refused and no further discharge application received to date.
Currently in breach of conditions 9, 18 and 20 of 19/P/01541.
