Planning Enforcement Request

Case reference FOI2018/01212

Published 23 October 2018

Request

Please would you be able to send me the number of planning breaches that were reported to your council each year for the past three years - and how many of these resulted in an enforcement notice being served? If an enforcement notice was not served, could you detail the primary reasons for this?

Response

Number of cases received:

2016 = 454

2017 = 415

2018 (to date) = 360

Of those enforcement cases received in each year, how many resulted in an enforcement notice:

2016 = 9

2017 = 8

2018 (to date) = 0

There are numerous reasons an enforcement notice may not have been served on files:

*no breach of planning control identified i.e. not a planning matter/ not development / permitted development

*solution to breach negotiated

*planning application received and approved

*not expedient to take further action i.e. limited planning harm / small technical breach

*alternative notice served on property i.e. Breach of condition notice; S215 Untidy site notice
